Murder Marketing Service Agreement
Effective version: October 12, 2026
This Service Agreement is between Treebird Branding LLC, which operates Murder Marketing (“Murder Marketing,” “we,” or “us”), and the business purchasing a Murder Marketing subscription (“Client” or “you”).
By checking the agreement acceptance box at checkout and completing your subscription purchase, you agree to this Agreement and authorize the recurring payments described below. The person accepting this Agreement represents that they have authority to enter into it on behalf of the Client.
1. Your selected package
Your subscription is for the service package you select at checkout, at the recurring price and billing frequency displayed before you complete your purchase and recorded in your subscription confirmation.
The description and inclusions for your selected package displayed on the Murder Marketing pricing page when you enroll form part of your scope of services. We will provide a copy of that scope with your enrollment confirmation. Any agreed written scope changes also form part of this Agreement.
Publicly advertised packages and prices are subject to change for future purchases. Your enrolled price and scope are governed by your subscription confirmation and this Agreement, including the fee-change procedure in Section 3.
Changes to our public pricing page do not automatically change your agreed scope or monthly fee. If a separately signed agreement expressly replaces a provision here, that signed agreement controls.
2. Six-month minimum and ongoing service
Your subscription requires a minimum engagement of six consecutive monthly billing periods. Your first billing period begins on the subscription start date established at checkout and recorded in your subscription confirmation, unless we agree to a different start date in writing.
The first month includes strategy, onboarding, account connections, and setup for your selected package. Ongoing production and management follow the agreed launch schedule. Setup counts as the first month of the six-month minimum.
After the initial six-month term, your subscription continues month to month until canceled under Section 4. It does not automatically end after six payments.
3. Monthly billing and payment authorization
Your first monthly service fee is charged at checkout. Your subscription is on automatic payment: subsequent monthly fees are automatically drafted through Stripe from your authorized payment method on each recurring billing date, without a separate payment request or authorization each month. Fees are billed in advance.
You authorize Murder Marketing and Stripe to automatically charge your selected card or debit your bank account, if bank payment is available and selected, for recurring subscription fees and any separately approved charges. Bank payments may require a separate bank-debit authorization at checkout and may take additional time to clear. Work may be held until the initial payment is confirmed.
Monthly renewals generally fall on the same calendar day as your subscription start date. If that day does not occur in a month, the renewal falls on that month’s last calendar day. Your subscription record controls the actual billing dates. You must maintain a valid payment method and accurate billing information.
Your service fee covers the selected package. Advertising spend, approved outside expenses, client-owned software, and applicable taxes are additional where disclosed. Any card processing surcharge must be separately disclosed before you authorize it and applied only where permitted.
If a payment fails, we will notify you and may pause work until payment is resolved. Removing a payment method or stopping payment does not, by itself, cancel this Agreement or eliminate amounts properly due.
Your enrolled monthly fee remains unchanged during the initial six-month term unless you approve a package change or other fee change in writing.
After the initial term, we may change your monthly fee with at least 30 days’ advance written notice stating the new fee and effective date. The effective date will allow you to cancel under Section 4 before the new fee applies. If you continue the subscription after that date, the revised fee applies to subsequent billing periods and is covered by your automatic-payment authorization.
A change to public website pricing alone does not change an existing subscription’s fee. The subscription must be updated in Stripe to apply a notified fee change.
4. Cancellation and package changes
To cancel, email thecrows@murdermarketing.com at least 30 calendar days before your requested end date. We will confirm the final service date and any remaining scheduled payments in writing.
Cancellation cannot take effect before the end of the initial six-month term, except under Section 12 or a separate written agreement. You may submit notice during the initial term for cancellation at its end.
After the initial term, cancellation takes effect at the end of the first monthly billing period that ends at least 30 days after we receive your notice. Service and scheduled billing continue through that date.
Package upgrades, downgrades, or pauses require written agreement. We will confirm the revised scope, fee, effective date, and any effect on your commitment before making the change.
Except where required by law, provided under Section 12, or agreed in writing, fees for billing periods already begun are not refundable or prorated.
5. Scope and additional work
We provide the services and deliverable quantities included in your selected package. The channels, priorities, and schedule will be established during onboarding and ongoing strategy discussions.
Requests outside the agreed scope require a separate estimate or written approval before work begins. Brand development, logo and identity work, full website builds, photo and video shoots, printing, installation, paid placements, and influencer fees are separate unless expressly included.
Advertising spend is paid separately to the advertising platforms. We do not mark up advertising spend or charge a percentage of it. You approve the advertising budget before launch.
Your package is a defined service engagement rather than an unlimited creative retainer. Unused monthly production capacity does not automatically roll over unless agreed in writing.
6. Your responsibilities and approvals
You will designate a primary contact who can approve work, provide account access, and answer questions. You agree to provide the requested onboarding homework within two weeks of kickoff and supply the brand files, content, information, and permissions reasonably needed for the work.
We will agree on approval deadlines in the project schedule. Delayed access, missing information, or late approvals may delay delivery or campaign launch. Client-caused delays do not automatically pause billing or extend the subscription term.
You are responsible for the accuracy of your business information, product claims, offers, prices, and materials supplied to us. You confirm that you have the necessary rights to any materials you provide.
For regulated industries, you are responsible for arranging any required legal or compliance review and approving applicable claims and disclosures before publication. We will not treat silence as approval of regulated content.
7. Creative, technology, and results
All visual design and supporting creative produced by Murder Marketing are custom and human-generated for your brand.
We may use technology and AI tools for research, analysis, monitoring, optimization, and written content where appropriate to the agreed scope. This does not change our commitment to human-led strategy and custom visual creative.
Marketing performance depends on factors including your offer, market conditions, budget, sales process, account history, and third-party platforms. We do not guarantee specific rankings, AI citations, media placements, lead volume, revenue, or return on advertising spend.
Search engines, advertising platforms, social networks, and other providers control their own systems, policies, availability, and decisions.
8. Accounts and ownership
You retain ownership of your business accounts, domains, existing brand assets, customer data, and materials you supply.
Upon full payment for the applicable work, you own the final, approved custom creative deliverables produced specifically for you, subject to third-party licensing requirements.
We retain ownership of our pre-existing materials, tools, templates, methods, workflows, unused concepts, and internal working files. Where our retained materials are incorporated into a paid final deliverable, we grant you a continuing license to use them as part of that deliverable for your business.
Third-party assets, fonts, software, and platform features remain subject to their owners’ terms. Source files and third-party license purchases are included only when expressly stated in your scope.
9. Confidentiality and data
Each party will protect the other party’s nonpublic business information and use it only to perform this engagement. Information may be shared with team members and service providers who need it for the work and are subject to appropriate confidentiality obligations.
This obligation does not apply to information already public, independently developed, lawfully received from another source, or required to be disclosed by law.
You authorize us to access and process the account and business data reasonably needed to provide your selected services. Each party remains responsible for its applicable privacy and data obligations. Sensitive or regulated personal data requiring special safeguards must be addressed in a separate written arrangement before it is shared.
10. Working relationship
Murder Marketing is an independent contractor. We may use qualified employees and subcontractors to deliver the services and remain responsible for their work under this Agreement.
We will not make purchases, commitments, or representations on your behalf beyond the authority you give us.
11. Liability
To the extent permitted by law, neither party is liable to the other for indirect, consequential, special, or punitive damages, including lost profits or lost opportunities.
Each party’s total liability arising from this Agreement is limited to the service fees paid or payable under this Agreement during the six months immediately preceding the event giving rise to the claim.
These limitations do not apply to fraud, willful misconduct, Client payment obligations, or liability that cannot legally be limited.
12. Material breach and ending service
If either party materially breaches this Agreement, the other may provide written notice identifying the breach and allow 15 calendar days to correct it. If the breach is not corrected within that period, the nonbreaching party may terminate the engagement by written notice.
We may immediately suspend activity that reasonably appears unlawful, infringes another party’s rights, or creates a material security risk, while we work with you to resolve it.
If you terminate because of our uncured material breach, future service fees after the termination date are not due, and we will refund prepaid fees for services we will not provide. If we end the engagement for our own convenience, the same treatment applies.
At the end of service, we will coordinate a reasonable handoff of your accounts and paid final deliverables. Amounts properly due remain payable. Confidentiality, ownership, liability, and dispute provisions continue as applicable.
13. Notices, disputes, and agreement changes
Send cancellation and other formal notices to thecrows@murdermarketing.com. We may send notices to the email address associated with your subscription or your designated business contact.
The parties will first attempt to resolve disputes through a good-faith conversation. This Agreement is governed by Georgia law, subject to applicable mandatory law. Any court proceeding will be brought in a court with appropriate jurisdiction in Fulton County, Georgia, unless applicable law requires another venue.
This Agreement, your selected package scope, and any separately agreed written terms form the entire agreement for the subscription. Changes require written agreement, except fee changes handled under Section 3. Publishing a revised agreement does not automatically change an existing Client’s contract.
If a provision is unenforceable, the remaining provisions continue in effect. A party’s delay in enforcing a provision does not waive its right to enforce it later.
14. Electronic acceptance
You agree to conduct this transaction electronically. By checking the required acceptance box and completing checkout, you intend to accept this Agreement on behalf of the Client and authorize the selected monthly subscription.
You acknowledge the six-month minimum commitment, ongoing monthly billing, separate advertising spend where applicable, and the cancellation notice requirement. You may save or print this Agreement for your records.
